You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
Promotions
Promotions may be governed by additional rules. If you participate, those rules apply and prevail in case of conflict.
User Accounts
- You must provide accurate and current information.
- You are responsible for safeguarding your credentials.
- Unauthorized, offensive, or misleading usernames are prohibited.
- You must notify us immediately of any breach of security.
User Content and Platform Responsibility
The Platform provides a space for users to create, share, and access content such as listings, posts, and comments. All content, whether submitted directly by users or posted by the Company on behalf of users, remains the sole responsibility of the individual or entity that provided the information.
If the Company assists in posting content on your behalf, you acknowledge and agree that such content is considered your own submission. You remain fully responsible for its accuracy, legality, and compliance with applicable laws.
The Company does not guarantee, endorse, or assume liability for any content posted by users. Any disputes, penalties, fees, or claims arising from such content shall be the sole responsibility of the user who provided the information.
By using the Platform, you agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any and all claims, liabilities, damages, or expenses (including legal fees) arising out of or related to your content.
Content Restrictions
You may not post content that is:
- Unlawful, defamatory, obscene, or offensive.
- Spam, unauthorized advertising, or fraudulent.
- Malware, viruses, or harmful software.
- Infringing on intellectual property rights.
- Impersonating others, including Company staff.
- False, misleading, or harmful to others.
The Company reserves the right to remove or edit any content at its sole discretion.
Content Moderation Policy
- The Company reviews content for compliance with laws and policies.
- Users may appeal moderation decisions via office@k-bang.com.
- Final decisions rest with the Company.
Community Guidelines and User-Generated Content Policy
kbang is committed to maintaining a safe and respectful community environment for all users.
We have a zero-tolerance policy toward any illegal, harmful, or offensive content.
The following types of content are strictly prohibited:
- Any illegal activity, violence, or sexual/explicit material.
- Hate speech, discrimination, harassment, spam, or fraudulent listings.
- Content infringing on others’ privacy, image, or intellectual property rights.
Users are fully responsible for the content they post.
Our moderation team actively monitors user content and may, at any time and without prior notice, remove or restrict access to any content or account that violates these rules.
If you encounter any inappropriate or suspicious content, please report it via email at office@k-bang.com or contact our Customer Support Center for assistance.
All reports will be reviewed and addressed within 24 hours, and repeated or severe violations may lead to permanent account suspension.
kbang reserves the right to take additional action, including notifying relevant authorities, when necessary to protect the community or comply with applicable law.
Community Guidelines and Moderation Policy
kbang maintains a zero-tolerance policy toward illegal, hateful, harassing, sexual, violent, or fraudulent content. Users may not post, share, or promote any material that violates laws or the rights of others.
Any content that is reported or found to violate these rules may be removed without prior notice, and the responsible account may be restricted or terminated. All reports are reviewed and addressed within 24 hours by our moderation team.
To report inappropriate or suspicious content, use the “Report”button available on each listing or email us at office@k-bang.com.
Content Backups
The Company does not guarantee the integrity or availability of content backups. Users must maintain independent copies of their content.
Intellectual Property Infringement
We respect intellectual property rights. If you believe your rights are infringed, contact us at office@k-bang.com. Misrepresentation may result in liability.
Refund Policy
- Listing fees are non-refundable once posted.
- We do not issue refunds or compensation for disputes between users.
- Refunds may only be considered if service interruption occurs due to Company error.
Data Protection and Security
We process personal data in line with our Privacy Policy, ensuring secure storage, limited retention, and user rights to access, correct, and delete their data.
Intellectual Property
The Platform and its original content, features, and functionality remain the property of the Company and its licensors. Unauthorized use is prohibited.
Your Feedback to Us
Feedback provided to the Company may be used freely under a perpetual, royalty-free license.
Links to Third-Party Websites and Services
The Service may contain links or advertisements from third parties. The Company is not responsible for third-party content, products, services, or disputes. All dealings are solely between users and such third parties.
Termination
We may suspend or terminate accounts immediately for breach of Terms. Users may also discontinue their accounts at any time.
Limitation of Liability
- Cap on Liability: Company’s liability is limited to the greater of CAD $100 or the amount you paid through the Service.
- Exclusions: No liability for indirect, incidental, or consequential damages (e.g., lost profits, data loss).
- Platform Disclaimer: The Company is not a party to user transactions and bears no responsibility for disputes.
"AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided without warranties of any kind. We do not guarantee uninterrupted operation, accuracy, or security.
Force Majeure
The Company shall not be liable for any delay or failure caused by events beyond its reasonable control, including natural disasters, governmental actions, internet or power outages, labor disputes, or system failures.
Class Action Waiver
By using the Service, you agree that any disputes will be resolved individually. You waive any right to participate in class actions, class arbitrations, or representative proceedings against the Company.
Governing Law and Jurisdiction
These Terms are governed by the laws of British Columbia, Canada. Disputes must be resolved exclusively in the courts of British Columbia.
Dispute Resolution
You agree to first attempt to resolve disputes informally by contacting the Company.
Severability
If any provision is invalid, the rest remain in effect.
Waiver
Failure to enforce any right or provision shall not constitute a waiver.
Changes to These Terms
We may update these Terms at our discretion. Material changes will be announced at least 30 days in advance. Continued use of the Service means acceptance of the revised Terms.
